Terms of Service
The terms that govern use of this website and engagement of Lehigh Acres Tree Service for tree work in Lehigh Acres and Lee County, Florida.
Agreement and Services
These Terms of Service govern your use of the website treeservicelehighacresfl.com and your engagement of Lehigh Acres Tree Service for tree work in Lehigh Acres and Lee County, Florida. By using this website or requesting an estimate, you agree to these terms. If you do not agree, please do not use the website or request services. We provide residential and commercial tree services, including tree removal, trimming and pruning, palm care, stump grinding, land and lot clearing, storm cleanup, cabling and bracing, and power-line clearance coordination, subject to the written estimate for each job.
Website content, including guides, cost ranges, and articles, is provided for general information only and does not constitute a binding quote, an arborist certification for a specific tree, or legal or insurance advice. Cost ranges on this site are typical figures for Lehigh Acres and vary with tree size, species, access, risk, and equipment needs. A binding price is given only in a written, itemized estimate prepared after a free on-site visit, and that estimate, together with any written change order, governs the scope and price of the work. Verbal estimates and website ranges are not binding.
Estimates, Scheduling, and Changes
Estimates are free and are valid for the period stated on the estimate, typically thirty days, after which prices may change due to tree growth, storm damage, access changes, or equipment availability. Scheduling is confirmed by agreement between you and the company, and dates may shift due to weather, especially afternoon storms and tropical systems during hurricane season, equipment issues, or emergency work that takes priority. We will communicate schedule changes as promptly as practical and will reschedule at a mutually agreeable time. You agree to provide accurate information about the property, including known underground utilities, septic components, irrigation lines, gate widths, and any HOA or county approval requirements.
Changes to the scope after work begins, such as additional trees, deeper stump grinding, or extra hauling, require a written change order with an agreed price before the additional work proceeds, except in an emergency where immediate action is needed to protect people or property, in which case we will document the change and the price promptly. You are responsible for obtaining HOA or county approvals before scheduled work unless we have agreed in writing to assist with specific paperwork, and work may be delayed if approvals are not in place. Cancellation of a scheduled job should be given as early as possible so the crew can be reassigned.
Property Access, Safety, and Customer Responsibilities
You grant our crew reasonable access to the property at the scheduled time, including through gates and driveways needed for equipment, and you agree to keep children and pets clear of the work area and to inform us of any hazards, such as aggressive animals, hidden wells, shallow utilities, or unstable structures. Tree work involves inherent risks, including falling limbs, equipment operation, and work at height, and our crew follows safety procedures to manage those risks, including rigging, drop-zone control, and coordination around power lines. You agree not to enter the work area, direct crew members to perform work outside the agreed scope, or attempt to assist with cutting or rigging, for your own safety and that of the crew.
We take reasonable care to protect lawns, pavers, plantings, fences, and structures, using mats and rigging paths where appropriate, but heavy equipment and falling debris can cause minor lawn disturbance, ruts in soft or wet ground, and dust or chips in the work area, and such ordinary effects are part of the agreed work unless the estimate states otherwise. Work near power lines is subject to utility requirements and clearance procedures, and we may decline or postpone work that cannot be performed safely until the utility has acted. Debris handling follows the estimate: hauling, chipping, and cleanup are included only where stated, and wood or chips left at your request become your property and responsibility.
Payment, Warranties, and Liability
Payment terms are stated on the estimate or invoice. Unless otherwise agreed in writing, payment is due upon completion of the work, and the company may require a deposit for large jobs, crane work, or multi-day clearings. Late payment may incur reasonable collection costs permitted by law. Workmanship is warranted as stated on the estimate; tree work does not carry a guarantee that a tree will survive pruning, that a retained tree will not fail in a future storm, or that a stump will not regrow suckers, because those outcomes depend on biology, weather, and site conditions beyond our control. Stump grinding is warranted to the depth stated on the estimate, and ground settling after grinding is a normal effect that may require topping up before sod or paving.
To the fullest extent permitted by Florida law, our liability for any claim arising from the website or from services is limited to the amount paid for the specific job giving rise to the claim, and we are not liable for indirect, incidental, or consequential damages, including loss of use, landscape value beyond the agreed scope, or costs arising from pre-existing conditions, hidden decay, or undisclosed utilities. Nothing in these terms limits liability for willful misconduct or for amounts that cannot be limited under applicable law. You agree to indemnify the company against claims arising from inaccurate information you provide, failure to obtain required approvals, or interference with the crew's safety procedures.
Governing Law, Disputes, and General Terms
These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising from these terms or from services will first be addressed through good-faith discussion between you and the company, and if it cannot be resolved that way, it will be resolved in the state or federal courts located in Lee County, Florida, and you consent to that jurisdiction. If any provision of these terms is found unenforceable, the remaining provisions continue in full effect, and a failure to enforce a provision does not waive the right to enforce it later.
We may update these terms from time to time, and the updated version will be posted on this page with a new revision date. Continued use of the website after an update constitutes acceptance of the updated terms, while work already contracted remains governed by the estimate and the terms in effect when it was agreed, unless a change is agreed in writing. Questions about these terms can be sent to [email protected] or by phone at (239) 686-1550. These terms were last updated on October 28, 2026.
